1. Acceptance of Terms

By accessing or using proxyAI (“the Service,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of the Terms, you may not access or use the Service.

These Terms apply to all visitors, registered users, and anyone else who accesses or uses the Service (“User,” “you,” or “your”).

2. Description of the Service

proxyAI is a cloud-based platform that provides access to artificial intelligence models through a single account and a single API key. Instead of managing separate accounts with each AI provider, Users can access AI services through proxyAI using prepaid credit.

Currently, the Service provides access to the DeepSeek AI model. We may add additional AI models in the future, and these Terms will apply to any new models we make available.

3. Business Model

proxyAI offers a prepaid digital service. Below is a summary of our business model:

  • ProxyAI sells “AI Credit.” AI Credit is a digital unit that represents the right to use the Service.
  • AI Credit must be purchased in advance (prepaid) before the Service can be used.
  • AI Credit is consumed each time a User makes an API request to the Service.
  • AI Credit and any associated fees are set out on our Pricing page.
  • proxyAI does not sell physical products.
  • proxyAI does not provide investment, lending, gambling, or any financial services.
  • proxyAI is purely a digital service provider.

4. Account Registration

To use the Service, you must create an account. When you register, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain and promptly update your account information as needed.
  • Keep your API key and password confidential and secure.
  • Accept full responsibility for all activity that occurs under your account.
  • Not create multiple accounts to bypass credit limits, usage restrictions, or registration limits.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for abusive or unauthorized purposes.

5. AI Credit & Billing

proxyAI operates on a prepaid AI Credit system with the following conditions:

  • AI Credit is purchased upfront at the rates displayed on our Pricing page.
  • Each API request consumes a specific amount of AI Credit depending on the AI model used. Current rates are available on the Pricing page and in your account dashboard.
  • All AI Credit purchases are final and non-refundable except as required by applicable consumer protection laws.
  • Unused AI Credit does not expire unless your account is terminated for a violation of these Terms.
  • We reserve the right to adjust AI Credit consumption rates. We will provide reasonable notice before any change takes effect.
  • All payments are processed securely through Xendit. We do not store or have access to your credit card or payment instrument details.
  • proxyAI does not offer subscriptions, recurring billing, or post-paid invoicing. All purchases are one-time prepaid top-ups.

6. How the Service Works

proxyAI manages the following on behalf of Users:

  • User account management (registration, authentication, security).
  • AI Credit system (purchase, balance tracking, consumption logging).
  • API endpoint management (request routing, authentication, rate limiting).
  • Billing and payment processing (invoicing, payment confirmation).
  • User dashboard (usage statistics, transaction history, API key management).

The underlying AI model (DeepSeek) is operated and maintained by its respective provider. proxyAI is responsible for managing the platform that enables Users to access this model through a unified account and billing system.

7. Acceptable Use

You agree not to use the Service for any of the following:

  • Any illegal purpose or in violation of any applicable local, national, or international law.
  • Generating, storing, or distributing content that is harmful, abusive, harassing, defamatory, or otherwise objectionable.
  • Attempting to bypass or circumvent rate limits, security measures, access controls, or IP-based restrictions.
  • Reverse engineering, decompiling, or disassembling any part of the Service.
  • Interfering with or disrupting the integrity, security, or performance of the Service.
  • Automated account creation, credential stuffing, or any bulk registration technique.
  • Using the Service in connection with any high-risk activities where failure could lead to death, personal injury, or significant property damage.

8. AI-Generated Content

The content generated through the Service is produced by the DeepSeek AI model based on input provided by the User. proxyAI does not control, endorse, verify the accuracy of, or assume responsibility for any AI-generated content. Users are solely responsible for the input they provide and the use they make of AI-generated outputs.

proxyAI may, at its discretion, block or restrict access to certain AI models or features if required by applicable law, regulatory guidance, or if we determine that such access presents an unacceptable risk.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

API request data, including prompts and responses, may be logged for purposes of usage tracking, billing, and platform troubleshooting. We do not sell your personal data to third parties. Request data is retained only as long as necessary for these purposes and in accordance with our data retention practices.

10. Service Availability

We strive to provide reliable and continuous access to the Service, but we do not guarantee 100% availability. The Service may be temporarily unavailable due to:

  • Scheduled maintenance or platform updates.
  • Outages or performance issues at our infrastructure partners (Vercel, Supabase, Upstash).
  • Outages or service interruptions at the DeepSeek AI model provider.
  • Events outside our reasonable control, including natural disasters, network failures, or cyberattacks.

We are not liable for any losses or damages incurred as a result of service interruptions, data loss, delayed responses, or degraded performance.

11. Limitation of Liability

To the fullest extent permitted by applicable law, proxyAI, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the total amount paid by you for AI Credit in the twelve (12) months immediately preceding the event giving rise to the claim.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach any provision of these Terms.

Upon termination, your right to use the Service will immediately cease. Any remaining AI Credit in your account at the time of termination for cause will be forfeited. If your account is terminated without cause, you may request a refund of unused AI Credit, which will be provided at our sole discretion.

13. Refund Policy

AI Credit purchases are non-refundable except as required by applicable consumer protection laws.

If you believe a billing error has occurred, please contact us within fourteen (14) calendar days of the transaction at support@proxyai.live. We will investigate promptly and correct any verified errors.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Service after any changes are posted constitutes your acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify you by email or through a notice on the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved, it shall be finally settled by the competent courts of Indonesia.
